# ATELIER GAÁL

## CLASS, WORKSHOP, PRIVATE LESSON & STUDIO RENTAL TERMS AND CONDITIONS

Atelier Gaál is operated by Seattle Papermaker LLC.

PLEASE READ THESE TERMS CAREFULLY BEFORE REGISTERING. THEY CONTAIN IMPORTANT PROVISIONS REGARDING CANCELLATIONS, REFUNDS, RESCHEDULING, INDUSTRIAL-STUDIO CONDITIONS, SAFETY REQUIREMENTS, PROPERTY DAMAGE, ASSUMPTION OF RISK, AND THE RELEASE OF CERTAIN CLAIMS, INCLUDING CLAIMS ARISING FROM ORDINARY NEGLIGENCE.

These Terms apply to purchases, registrations, attendance, and participation in classes, workshops, private lessons, studio rentals, open-studio sessions, and other instructional or studio activities offered by Atelier Gaál.

If a purchaser registers another person, purchases multiple registrations, or makes a group booking, each actual participant is independently subject to applicable studio and participation requirements and must complete any participant acknowledgment, safety agreement, assumption-of-risk agreement, or liability release required by Atelier Gaál before participating.

# REGISTRATION, PAYMENT & CANCELLATION

## 1. Registration

Registration is confirmed when Atelier Gaál receives the tuition or booking amount required at checkout.

Class sizes are limited. A confirmed registration reserves space that may no longer be available for sale to another participant.

Except for the 72-hour cancellation period described below, an applicable exception expressly provided by these Terms, cancellation by Atelier Gaál as provided below, or where otherwise required by law, REGISTRATIONS AND TUITION PAYMENTS ARE NON-REFUNDABLE ONCE BOOKED.

## 2. Tuition Does Not Include Separately Stated Materials Fees

TUITION PAID AT CHECKOUT DOES NOT INCLUDE, AND SHALL NOT BE UNDERSTOOD OR INTERPRETED TO INCLUDE, ANY SEPARATELY STATED SUPPLIES OR MATERIALS FEE DUE ON-SITE.

Where a class description identifies a separate supplies and materials fee, that amount is an additional charge and must be paid as specified for that class.

References to “full payment,” “payment in full,” “tuition paid in full,” or similar language refer only to the tuition or booking amount charged at checkout unless Atelier Gaál expressly states otherwise in writing.

Attendance at a class for which a separate supplies and materials fee is required constitutes an obligation to pay that fee.

## 3. 72-Hour Cancellation Period

Atelier Gaál operates within an active industrial environment. Purchasers and participants should carefully review the studio conditions, accessibility information, footwear requirements, and safety provisions contained in these Terms.

A purchaser may cancel a new booking within 72 hours after the time the booking is made by providing written notice to Atelier Gaál by email.

A timely cancellation under this provision will receive a full refund of the tuition or booking amount paid to Atelier Gaál.

After the 72-hour cancellation period expires, the registration becomes NON-REFUNDABLE, except as expressly provided by these Terms or required by applicable law.

## 4. Rescheduling

After expiration of the 72-hour cancellation period, an eligible registration may be rescheduled a maximum of two times if Atelier Gaál receives written notice by email at least 30 calendar days before the first scheduled day of the class.

Rescheduling is:

* subject to availability;

* subject to satisfaction of any prerequisite applicable to the replacement class; and

* subject to payment of any increase in tuition, materials fees, or other applicable charges.

No monetary refund or credit for the difference will be issued if the replacement class costs less.

After a registration has been rescheduled twice, it is final and may not be rescheduled again.

Requests received fewer than 30 calendar days before the first scheduled class day are not eligible for ordinary rescheduling except as Atelier Gaál may permit under Section 6.

## 5. No-Call/No-Shows, Late Arrivals & Missed Class Time

Failure to attend a scheduled class without prior notice constitutes a no-call/no-show.

A no-call/no-show forfeits the registration and amounts paid and does not entitle the participant or purchaser to a refund, credit, transfer, replacement class, or rescheduling.

Late arrival, early departure, or absence from any portion of a class or multi-day program does not entitle a participant to a partial refund, make-up instruction, additional studio time, or extension of the class.

## 6. Medical Emergencies & Exceptional Circumstances

Atelier Gaál recognizes that genuine emergencies occur.

In cases involving a documented medical emergency, serious illness or injury, death or serious illness in the participant's immediate family, or another comparable extraordinary circumstance outside the participant's reasonable control, Atelier Gaál may waive an ordinary rescheduling deadline or provide another reasonable accommodation.

Atelier Gaál may request reasonable supporting documentation.

Except where otherwise required by law, Atelier Gaál will determine the appropriate accommodation based upon the circumstances. An accommodation may consist of rescheduling, transfer, or class credit rather than a monetary refund.

An exception made in one instance does not establish a right to the same exception in another.

Nothing in these Terms limits any cancellation, refund, or consumer right that cannot lawfully be waived.

## 7. Cancellation or Changes by Atelier Gaál

Atelier Gaál may cancel, postpone, reschedule, relocate, or reasonably modify a class when necessary, including because of overbooking, insufficient enrollment, instructor illness or emergency, unsafe conditions, equipment or facility problems, utility interruption, severe weather, building conditions, or circumstances outside Atelier Gaál's reasonable control.

If Atelier Gaál cancels a participant's registration because of overbooking, the purchaser will receive a full refund of amounts paid to Atelier Gaál for that registration.

If Atelier Gaál cancels an entire class and does not offer an acceptable replacement date, affected purchasers will receive a full refund of amounts paid to Atelier Gaál for that class.

Except where otherwise required by law, Atelier Gaál and Seattle Papermaker LLC are not responsible for airfare, lodging, transportation, parking, meals, lost wages, lost business opportunities, or other incidental or consequential expenses arising from attendance, cancellation, postponement, or rescheduling.

# INDUSTRIAL STUDIO CONDITIONS & SAFETY

## 8. Active Industrial Environment

ATELIER GAÁL IS AN ACTIVE WORKING STUDIO LOCATED WITHIN AN INDUSTRIAL BUILDING. IT IS NOT A CONVENTIONAL CLASSROOM, RETAIL STORE, OR PUBLIC EVENT SPACE.

The building is occupied by other commercial and industrial tenants conducting activities outside Atelier Gaál's ownership and control.

The building and studio may contain or experience machinery, commercial or industrial equipment, tools, electrical equipment, chemicals, pigments, paints, inks, adhesives, solvents, powders, sharp instruments, heavy objects, hot equipment or surfaces, water, wet or slippery floors, hoses, cords, uneven or obstructed working areas, noise, vibration, odors, deliveries, vehicles, commercial activity, and other conditions associated with an active industrial property and professional working studio.

Participants acknowledge that these conditions may exist before, during, and after instructional activities.

A purchaser who determines after reviewing these disclosed conditions that the environment is unsuitable may exercise the 72-hour cancellation right provided in Section 3.

## 9. Other Building Tenants

Atelier Gaál shares the building with other tenants whose employees, visitors, activities, equipment, materials, and operations are outside Atelier Gaál's control.

Participants must respect all other tenants, their employees, property, workspaces, equipment, materials, and operations.

Participants may not enter another tenant's workspace or touch, photograph, operate, move, interfere with, or otherwise interact with another tenant's equipment, tools, materials, work product, or other property without express authorization.

## 10. Restricted Equipment, Tools & Materials

PARTICIPANTS MAY NOT TOUCH, OPERATE, MOVE, OPEN, HANDLE, USE, OR INTERFERE WITH ANY MACHINE, EQUIPMENT, TOOL, CHEMICAL, MATERIAL, SUPPLY, CABINET, STORAGE AREA, WORK IN PROGRESS, OR OTHER PROPERTY UNLESS IT HAS BEEN EXPRESSLY DESIGNATED FOR PARTICIPANT USE OR THE INSTRUCTOR HAS EXPRESSLY AUTHORIZED ITS USE.

The presence, visibility, accessibility, or proximity of an item does not constitute permission to touch or use it.

Participants must remain within designated instructional and participant-use areas and comply promptly with verbal and posted safety instructions.

These restrictions apply to property belonging to Atelier Gaál, Seattle Papermaker LLC, the building owner or manager, other tenants, and other persons within the premises.

## 11. Footwear

APPROPRIATE FOOTWEAR IS REQUIRED AT ALL TIMES.

Footwear must:

* fully enclose the foot;

* remain securely attached to the foot;

* provide substantial traction appropriate for wet or potentially slippery surfaces; and

* be suitable for an active industrial working studio.

Flip-flops, sandals, slippers, open-toed footwear, open-backed footwear, unsecured slip-on footwear, and footwear without adequate traction are prohibited.

Steel-toed or comparable protective work footwear is strongly recommended.

Atelier Gaál may refuse studio access to a participant whose footwear does not comply with these requirements or otherwise presents an unreasonable safety risk.

Refusal of entry resulting from a participant's failure to comply with the disclosed footwear requirements does not entitle the participant or purchaser to a refund, credit, transfer, or rescheduling.

## 12. Wet & Slippery Floors

Marbling, papermaking, cleaning, and related studio processes involve substantial quantities of water.

PARTICIPANTS SHOULD EXPECT STUDIO FLOORS TO BECOME WET AND POTENTIALLY SLIPPERY DURING NORMAL ACTIVITIES.

Participants must:

* look where they are walking at all times;

* walk rather than run;

* exercise particular care around trays, sinks, hoses, cords, work areas, and wet surfaces;

* wear footwear providing adequate traction; and

* promptly report spills or hazardous floor conditions requiring attention.

Participants expressly acknowledge that slipping, tripping, and falling are foreseeable risks associated with participation in studio activities and presence within the disclosed environment.

## 13. Noise

Atelier Gaál is located within an active industrial building.

Machinery, tools, deliveries, building operations, other tenants, and studio activities may produce intermittent or sustained noise during class hours.

Noise-cancelling headphones, earmuffs, or other appropriate personal hearing protection are strongly encouraged.

Participants with particular noise sensitivities should determine whether the disclosed environment is appropriate for them before expiration of the applicable cancellation period.

## 14. Parking & Transportation

NO ON-SITE PARKING IS AVAILABLE FOR STUDENTS OR VISITORS.

Participants are responsible for arranging their own transportation and lawful off-site parking and should allow sufficient time to park and arrive before the scheduled class time.

Atelier Gaál does not control or guarantee the availability, security, cost, restrictions, or enforcement of street or other off-site parking.

Except where otherwise required by law, Atelier Gaál and Seattle Papermaker LLC are not responsible for parking charges, citations, towing, theft, vehicle damage, or other parking-related expenses or losses.

## 15. Accessibility

THE ATELIER GAÁL STUDIO IS LOCATED IN AN INDUSTRIAL SPACE AND IS NOT PRESENTLY ADA ACCESSIBLE.

Prospective participants with accessibility needs should contact Atelier Gaál before booking to discuss the physical characteristics of the premises, requirements of the activity, and whether a reasonable accommodation may be available.

Nothing in these Terms is intended to waive, restrict, or diminish any right or obligation that cannot lawfully be waived under applicable disability-access law.

## 16. Safety & Conduct

Participants must comply with all posted notices, safety requirements, and reasonable verbal instructions.

Running, horseplay, reckless conduct, deliberate misuse of equipment, unauthorized handling of materials or equipment, interference with another tenant, and conduct creating an unreasonable risk to any person or property are prohibited.

Atelier Gaál may immediately suspend or terminate a participant's access if the participant:

* disregards safety instructions;

* enters a restricted area;

* touches or operates unauthorized equipment;

* uses tools or materials improperly;

* interferes with another tenant or its property;

* engages in threatening, harassing, destructive, or reckless behavior; or

* otherwise creates an unreasonable safety or operational risk.

Removal for a serious safety or conduct violation does not entitle the participant or purchaser to a refund, credit, transfer, or rescheduling.

## 17. Health, Allergies & Material Sensitivities

Studio materials may include pigments, paints, inks, surfactants, mordants, adhesives, solvents, powders, natural materials, and other substances capable of producing irritation, allergic reactions, or sensitivities in susceptible individuals.

Participants are responsible for notifying Atelier Gaál before participation of any known allergy, material sensitivity, physical limitation, or other circumstance materially affecting safe participation.

Participants should not use any material they know or reasonably suspect may cause an adverse reaction and should ask the instructor before handling unfamiliar materials if they have concerns.

## 18. Clothing & Personal Property

Participants should wear clothing suitable for an active working studio.

Water, pigments, paints, inks, dyes, chemicals, adhesives, and other studio materials may permanently stain or damage clothing, footwear, jewelry, watches, phones, bags, and other personal property.

Participants are responsible for securing and protecting their personal property.

Except to the extent otherwise required by law, Atelier Gaál and Seattle Papermaker LLC are not responsible for ordinary staining, soiling, loss, or damage to personal property resulting from participation in studio activities or a participant's failure to protect personal belongings.

# PROPERTY DAMAGE & REIMBURSEMENT

## 19. Participant Responsibility for Property Damage

Participants are responsible for exercising reasonable care in their use of the premises and property made available to them.

TO THE FULLEST EXTENT PERMITTED BY LAW, A PARTICIPANT IS FINANCIALLY RESPONSIBLE FOR LOSS OF OR DAMAGE TO PROPERTY CAUSED BY THAT PARTICIPANT'S NEGLIGENT, RECKLESS, INTENTIONAL, UNAUTHORIZED, OR IMPROPER CONDUCT, INCLUDING FAILURE TO FOLLOW STUDIO RULES OR INSTRUCTOR DIRECTIONS.

Covered property includes property belonging to or under the responsibility of:

* Atelier Gaál;

* Seattle Papermaker LLC;

* the building owner or property manager;

* other building tenants;

* instructors, employees, contractors, or agents; and

* other participants or visitors.

This includes damage resulting from unauthorized touching, handling, moving, operation, or use of machinery, equipment, tools, materials, chemicals, works in progress, furnishings, fixtures, or other property.

The responsible participant agrees to reimburse Seattle Papermaker LLC and/or the affected property owner for reasonable amounts actually incurred as a direct result of the participant's conduct, including reasonable costs of cleaning, remediation, repair, restoration, or replacement, as applicable.

Where damaged property can reasonably and economically be restored, reimbursement ordinarily will be based upon the reasonable cost of repair or restoration.

Where property is destroyed, lost, rendered unsafe, or cannot reasonably or economically be restored, reimbursement may include the reasonable cost of replacement with property of comparable type, quality, and functionality.

Participants are not responsible under this provision for ordinary wear and tear, preexisting damage, or loss or damage not caused by their conduct.

Damage, breakage, spills affecting property or equipment, or other loss must be reported to Atelier Gaál immediately.

Payment or reimbursement for damage does not prevent Atelier Gaál from terminating participation or studio access for serious, reckless, intentional, or unauthorized conduct.

# ASSUMPTION OF RISK & RELEASE OF LIABILITY

## 20. Acknowledgment & Assumption of Risk

PARTICIPANTS UNDERSTAND THAT ATTENDANCE AND PARTICIPATION IN ACTIVITIES WITHIN AN ACTIVE INDUSTRIAL WORKING STUDIO INVOLVE RISKS OF PERSONAL INJURY, PROPERTY DAMAGE, ILLNESS, AND OTHER LOSS.

Such risks include, without limitation:

* slips, trips, and falls;

* wet and slippery floors;

* cuts and punctures;

* splashes;

* burns;

* contact with tools, machinery, or equipment;

* falling, moving, or shifting objects;

* exposure to noise, vibration, dust, odors, pigments, paints, inks, adhesives, chemicals, powders, and other materials;

* allergic reactions or material sensitivities;

* activities of other participants;

* activities occurring elsewhere within the industrial building;

* conditions within building common areas; and

* staining, loss of, or damage to clothing or personal property.

Participants knowingly and voluntarily assume the inherent and ordinary risks associated with the activities and disclosed studio environment.

## 21. EXPRESS RELEASE OF CLAIMS FOR ORDINARY NEGLIGENCE

TO THE FULLEST EXTENT PERMITTED BY WASHINGTON LAW, EACH PARTICIPANT KNOWINGLY AND VOLUNTARILY RELEASES, WAIVES, AND DISCHARGES SEATTLE PAPERMAKER LLC, OPERATING ATELIER GAÁL, TOGETHER WITH ITS MEMBERS, MANAGERS, EMPLOYEES, INSTRUCTORS, AGENTS, REPRESENTATIVES, CONTRACTORS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”), FROM CLAIMS FOR PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY IN CONNECTION WITH THE PARTICIPANT'S ATTENDANCE AT OR PARTICIPATION IN AN ATELIER GAÁL ACTIVITY, INCLUDING ORDINARY NEGLIGENCE RELATING TO THE DISCLOSED CONDITION, MAINTENANCE, OR OPERATION OF THE STUDIO, TO THE EXTENT SUCH CLAIMS MAY LAWFULLY BE RELEASED IN ADVANCE.

PARTICIPANT EXPRESSLY UNDERSTANDS THAT THIS PROVISION IS INTENDED TO RELEASE CLAIMS THAT COULD OTHERWISE BE ASSERTED AGAINST A RELEASED PARTY BASED UPON THAT RELEASED PARTY'S OWN ORDINARY NEGLIGENCE.

This release does not extend to gross negligence, reckless or intentional misconduct, or liability that cannot lawfully be released or waived.

## 22. Participant's Own Conduct

Participants accept financial and other responsibility to the extent provided by applicable law for injury, loss, cost, or property damage caused by their own negligent, reckless, intentional, unauthorized, or improper conduct, including:

* failure to follow safety instructions;

* failure to watch where they are walking;

* use of prohibited or unsafe footwear;

* unauthorized handling or operation of equipment;

* entry into restricted areas;

* misuse of tools, chemicals, or materials;

* interference with another tenant or its property; or

* other failure to exercise reasonable care.

# CLASS & STUDIO-SPECIFIC TERMS

## 23. Prerequisites

Classes identified as Intermediate, Advanced, or otherwise requiring prior experience have genuine prerequisites.

By registering, participants represent that they possess the experience identified in the applicable class description.

Atelier Gaál may contact a participant to discuss previous training or experience and may determine that a participant lacks the experience reasonably necessary to participate safely or successfully.

Where reasonably practicable, Atelier Gaál may permit transfer to a more appropriate offering, subject to availability and payment of any applicable difference in tuition or fees.

## 24. Studio Rentals

Studio rental provides access only to equipment, tools, work areas, and materials expressly designated for renter use.

Studio rental constitutes independent working time and does not include instruction unless separately arranged.

Renters are expected to possess the experience stated in the Studio Rental description and to work safely and independently.

All provisions concerning industrial conditions, safety, restricted equipment, footwear, wet floors, assumption of risk, property damage, reimbursement, and release of liability apply to studio rentals.

## 25. Photography & Recording

Participants may photograph their own work unless otherwise instructed.

Photography or recording of other participants, private or restricted studio areas, other tenants or their workspaces, proprietary demonstrations, works in progress, or instructional materials may be prohibited or restricted.

Commercial filming, photography, or recording requires prior written authorization from Atelier Gaál.

## 26. Instructional Materials & Intellectual Property

Written materials, handouts, demonstrations, instructional content, course materials, photographs, videos, designs, and other proprietary materials supplied by Atelier Gaál remain the intellectual property of their respective owners unless expressly stated otherwise.

Enrollment permits use of instructional materials for the participant's personal educational and studio practice.

Registration does not grant permission to reproduce, publish, distribute, sell, record, commercially exploit, or use Atelier Gaál instructional materials to teach others without prior authorization.

# PURCHASERS & ACTUAL PARTICIPANTS

## 27. Purchases for Other People, Gifts & Group Bookings

The person purchasing a registration is not necessarily the person who will participate.

A purchaser who registers another person, purchases a seat as a gift, purchases multiple seats, or makes a private or group booking agrees to provide these Terms to every participant covered by the booking before attendance.

THE PURCHASER'S ACCEPTANCE OF THESE TERMS DOES NOT SUBSTITUTE FOR A SEPARATE ACKNOWLEDGMENT, ASSUMPTION OF RISK, RELEASE OF LIABILITY, SAFETY AGREEMENT, OR OTHER DOCUMENT THAT ATELIER GAÁL REQUIRES FROM THE ACTUAL PARTICIPANT.

Each adult participant, regardless of who purchased or paid for the registration, must individually review and accept Atelier Gaál's applicable safety requirements, assumption-of-risk provisions, and release of liability before participating in an activity or entering designated working areas of the studio.

Atelier Gaál may obtain that acceptance electronically before arrival or through an electronic or written acknowledgment at the studio.

A PARTICIPANT WHO HAS NOT COMPLETED A REQUIRED PARTICIPANT ACKNOWLEDGMENT OR RELEASE MAY NOT PARTICIPATE OR ENTER DESIGNATED WORKING AREAS OF THE STUDIO.

Failure or refusal to execute a required participant acknowledgment or release does not constitute cancellation by Atelier Gaál and, after expiration of any applicable cancellation period, does not entitle the purchaser or participant to a refund, credit, transfer, or rescheduling.

For private lessons, group bookings, studio rentals involving multiple people, gift registrations, or purchases of multiple seats, each adult participant must separately satisfy these requirements. One person's acceptance does not constitute acceptance on behalf of another competent adult.

The purchaser is responsible for providing accurate participant information reasonably requested by Atelier Gaál for administration of the registration and participant acknowledgments.

# GENERAL CONTRACT TERMS

## 28. Governing Law & Venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

To the extent permitted by applicable law, any legal proceeding arising from these Terms or participation in an Atelier Gaál activity shall be brought in a court of competent jurisdiction located in King County, Washington.

## 29. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law or severed to the minimum extent necessary, and the remaining provisions shall remain in effect.

## 30. No Waiver

Failure by Atelier Gaál or Seattle Papermaker LLC to enforce a provision on one occasion does not constitute a waiver of that provision or the right to enforce it subsequently.

An accommodation, exception, refund, credit, or rescheduling granted in one instance does not establish a course of dealing or obligation to provide the same accommodation in another instance.

## 31. Entire Agreement

These Terms, together with the applicable class or service description and any additional written terms expressly incorporated into the registration, constitute the agreement concerning registration and participation.

No oral statement or representation modifies these Terms unless expressly confirmed in writing by an authorized representative of Seattle Papermaker LLC.

## 32. Electronic Acceptance

Electronic acceptance of these Terms, including acceptance through an online checkout or registration process, constitutes agreement to these Terms to the extent permitted by applicable law.

## 33. Participant Acknowledgment

Before participating, each participant acknowledges that the participant:

1. has received or had access to these Terms and has had an opportunity to review them;

2. understands the cancellation, refund, and rescheduling provisions;

3. understands that separately stated supplies and materials fees due on-site are not included in tuition paid at checkout;

4. understands that Atelier Gaál operates within an active industrial building occupied by other tenants;

5. understands that no on-site student or visitor parking is available;

6. understands the disclosed accessibility limitations;

7. understands and agrees to comply with footwear and safety requirements;

8. understands that studio floors may become wet and slippery and that slips, trips, and falls are foreseeable risks of the disclosed environment;

9. agrees not to touch, operate, move, or otherwise interact with equipment, tools, chemicals, materials, supplies, or property not expressly designated or authorized for participant use;

10. agrees not to enter or interfere with the workspaces, equipment, property, employees, or operations of other building tenants;

11. accepts financial responsibility for property loss or damage caused by the participant as provided in these Terms;

12. knowingly and voluntarily assumes the disclosed inherent and ordinary risks associated with participation and presence in the studio;

13. understands that each adult participant must individually accept applicable safety and liability provisions regardless of who purchased the registration; and

14. UNDERSTANDS THAT THESE TERMS CONTAIN AN EXPRESS RELEASE OF CERTAIN CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF SEATTLE PAPERMAKER LLC, OPERATING ATELIER GAÁL, AND THE OTHER RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY WASHINGTON LAW.
